This document is a response to a Freedom of Information Act (FOIA) request from John Greenewald, of The Black Vault, for records related to Frank Kimbler and his collection of material in or around Roswell, New Mexico. The request was received by the BLM on February 4, 2019. In accordance with FOIA requirements, the BLM has conducted a thorough search of the Roswell Field Office. Agency records responsive to the request were identified, and the BLM is releasing 46 pages with no redactions. In addition, the BLM is partially withholding 3 pages containing personal phone numbers under Exemption 6 of the FOIA. The BLM states that Exemption 6 allows an agency to withhold "personnel and medical files and similar files the disclosure of which would constitute a clearly unwarranted invasion of personal privacy." The agency must balance the privacy interest against any public interest in the information. The BLM has determined that releasing the partially withheld records would harm an interest protected by one or more of the nine exemptions to the FOIA's general rule of disclosure. The BLM is granting the request for fee waiver. The requester may appeal this response to the Department's FOIA/Privacy Act Appeals Officer. If an appeal is chosen, it must be made in writing and received within 90 workdays from the date of this letter. The BLM has also provided information on how to contact the FOIA Public Liaison and the Office of Government Information Services (OGIS) for mediation services.
