On June twentieth, the Chinese chartering agency, Zhongzu, requested the Swiss owners of a ship which had previously visited a Chinese port with a cargo of twenty‑six thousand five hundred tons of U.S. corn to send it to Haiphong to discharge the balance of the cargo. Apparently, however, the owners denied the request because the vessel is now scheduled to discharge at the North China port of Qinhuangdao in mid‑July. On June twenty‑four, a second ship with a cargo of twenty‑three thousand tons of U.S. corn received a request from Zhongzu to discharge the cargo in Haiphong. In this case, the owners agreed, and this second ship is now scheduled to pick up navigational charts in the southern Chinese port of Huangpu in mid‑July before proceeding to Haiphong. In addition, an intercepted NVN message indicated that a third ship with about twenty‑six thousand tons of U.S. corn “for transshipment to North Vietnam” would arrive at Huangpu on June twenty‑eighth; the ship arrived there July first. However, we do not yet have confirmation that any U.S. grain has actually reached North Vietnam. 2. This is the first information we have had on possible PRC diversion of U.S. grain to North Vietnam. The PRC is undoubtedly aware of the U.S. embargo on direct trade with North Vietnam, but we do not know if the Chinese know that our regulations also cover such diversions. We have no record that the United States Government has discussed this general subject with the PRC. 3. Because of the complete U.S. embargo on trade with North Vietnam, such diversions by the PRC are contrary to U.S. Government regulations. However, there is nothing in our laws and regulations which makes it mandatory for the United States Government to take action in a case like this. Our regulations are concerned primarily with a situation in which a U.S. exporter or a foreign company knowingly engages…
