Constitutional law professor Julie Suk acknowledges the obvious: the conservative majority on the Supreme Court is increasingly extreme, out of touch, and unaccountable to the democratic majority.
The spouses of Justices Alito and Thomas actively support the violent insurrection. Justice Kavanaugh is against affirmative action, but he’s fine with ICE using racial profiling to go after immigrants in California. Justice Roberts fashions himself a moderate even as he singlehandedly guts the Voting Rights Act. These “originalists” were one vote away from doing away with birthright citizenship and gleefully expanded executive power for Donald Trump to enact his fascist agenda and escape his numerous scandals.
Increasingly, people demand reform, whether it’s in the form of term limits and/or court expansion. Unfortunately, we are stuck with a feckless Democratic Party that is incapable of fighting and prefers collaboration, civility, and cowardice. However, the problems persist, and we need some creative solutions moving forward.
Suk proposes a non-binding alternative to the Supreme Court made up of diverse judges who actually reflect the will of the people. They would issue rulings on cases, and Democrats then publicize them so people appreciate what a non-corrupt Supreme Court would actually look like. This in turn would help the ongoing push for Supreme Court reform.
Suk joins The Left Hook to discuss her bold, creative plan to save our democracy from a rogue Court.
