Jeremy “GERM” Hales got his federal forum. He obtained favorable findings on jurisdiction and service. His factual allegations received the generous assumptions required at the motion-to-dismiss stage. He amended his lawsuit again and again.
He still couldn’t state a legal claim against Richard Luthmann.
Today, Richard Luthmann Live convenes a rotating panel of journalists, legal analysts, content creators, and Halesverse observers to read United States Magistrate Judge Zachary C. Bolitho’s September 2, 2026, Report and Recommendation in Jeremy B. Hales v. Richard Luthmann, Jr., et al., Case No. 1:25-cv-00058-RH-ZCB.
Bolitho recommends granting Luthmann’s motion to dismiss Count Two of Hales’ Third Amended Complaint with prejudice. If District Judge Robert L. Hinkle adopts that recommendation, Luthmann is out of Fed 2. Hales’ remaining dispute with Lynette Michelle Preston continues separately.
Fed 2 began as a sprawling lawsuit against journalists, commentators, and online critics. Defendant after defendant disappeared until Hales’ case against Luthmann rested on one extraordinary theory: an obvious piece of internet parody violated Florida’s sexual-cyberharassment statute, a law written to punish the nonconsensual dissemination of actual intimate material.
Hales and attorney Randall “Randy” Shochet tried to force satire into a revenge-porn statute. Luthmann’s answer never changed: show the frame.
Where was the nudity? Where were the exposed breasts, genitals, or buttocks required by the statute? Where was the actual or statutorily defined simulated sexual conduct? Where was the private intimate image entrusted to Luthmann and published without consent?
Bolitho examined the video and found none of it.
The Report describes Hales’ face, an added Hitler mustache, another person’s clothed body, superimposed images, and “clearly satirical elements.” The court assumed Hales’ allegations were true and still concluded that the publication did not contain a “sexually explicit image” under the governing version of Florida law. Bolitho called the video “vulgar, offensive, and juvenile.” He also concluded that it did not constitute sexual cyberharassment.
That is the collapse of Hales’ lawfare theory. The First Amendment victory follows close behind. Bolitho did not enter a constitutional ruling under Hustler Magazine v. Falwell, but his statutory analysis reaches the same practical battlefield: unmistakable parody does not become unlawful intimate imagery because its target is humiliated, enraged, or politically connected.
The Report contains adverse findings for Luthmann. Bolitho rejected his jurisdictional argument, found substituted service sufficient, and accused him of treating service like “a game of cat and mouse.” Luthmann disputes that account and will explain why. Those findings gave Hales every opportunity to reach the merits. Once he arrived, his claim died there.
The magistrate judge recommends dismissal with prejudice because Hales has already received multiple opportunities to amend. Hales may file objections within fourteen days of the September 2 Report. Judge Hinkle will decide whether to adopt, reject, or modify the recommendation.
