Yesterday, I started a series on the Comstock Act of 1873. You know, the zombie law you’re hearing about in relation to outlawing the mailing of abortion drugs after the midterm elections.
Today, let’s review everything a White Christian Nationalist might classify as OBSCENE MATERIALS and SEXUAL IMPLEMENTS under the Comstock Act.
Because for a woman who’s never seen a porn film, I have spilled more words about WCN and porn/obscenity than just about any other topic.
On 26 January 2024, I wrote my second-ever Substack newsletter. It was called HOW PROJECT 2025 AUTHORS DEFINE PORNOGRAPHY.
Because Project 2025, page 5 contained this Kevin Roberts jewel:
Pornography should be outlawed. The people who produce and distribute it should be imprisoned. Educators and public librarians who purvey it should be classed as registered sex offenders. And telecommunications and technology firms that facilitate its spread should be shuttered.
In that piece, I provided a list of everything a White Christian Nationalist might deem obscene (and thus subject to the Comstock Act):
Artworks featuring nudity, partial nudity, suggestions of sex, allusions to homosexuality, or other erotic depictions of the female form
Books/stories/films/videos/artworks/photographs featuring physical contact of any kind other than between one man and one woman who are married
Homosexuality
Transgender bodies
Films featuring nudity, partial nudity, suggestions of sex, allusions to homosexuality, or other erotic depictions of the female form
Music with explicit lyrics, foul language, sexual situations, erotic sounds, or anything else that makes someone think about sex
Images of scantily clad women or women wearing clothing that outlines their bodies
Live performances that glorify homosexuality, transgender bodies, sexual contact outside of marriage between one man and one woman, nudity, partial nudity, single motherhood, the questioning of faith (which they call “The Truth”), and taking their One True God’s name in vain
Any publication, artwork, book, film, image, song, performance or website that features content that might make a man like House Speaker Mike Johnson think about sex
Now let’s look at the language from a failed Oklahoma bill (which was proposed multiple times) to outlaw pornography and obscenity. Items in (parenthesis) are added commentary by me:
“
” means and includes any representation, performance, depiction or description of sexual conduct, whether in any form or on any medium including still photographs, undeveloped photographs, motion pictures, undeveloped film, videotape, optical, magnetic or solid-state storage, CD or DVD, or a purely photographic product or a reproduction of such product in any book, pamphlet, magazine, or other publication or electronic or photo-optical format, if said items contain the following elements:Obscene materiala. depictions or descriptions of sexual conduct which
,are patently offensive as found by the average person (this means a White Christian Nationalist person) applying contemporary (White Christian Nationalist) community standardsb. taken as a whole, have as the dominant theme an appeal to

Here’s a 19 December 2024 piece I wrote on a Texas bill that would outlaw the sale of SEXUAL IMPLEMENTS (vibrators, dildos, etc) in most Texas businesses. They used the “violation of community values argument” to propose it, but they could just as easily use Comstock to enforce it without rewriting any state law.
White Christian Nationalists can use the Comstock Act to ban anything they deem to be obscene, pornographic, overtly sexual, and/or offensive. Given all the energy they’re expending to surveil us all the way into our bedrooms and most private spaces, don’t think they wouldn’t use the Comstock Act to prosecute and jail Americans for “obscenity” and “indecency.”
Anthony Comstock might have been a compulsive wanker, but your right to wank in peace while consuming your favorite erotic creation is literally on the midterm ballot, Americans.
Americans think the right to contraception is settled law. IT IS NOT.
Here are more links to even more newsletters I’ve written about WCN, porn, obscenity, indecency, and sex. (I seriously ought to get a book deal to write about WCN and porn. Which might make my mother’s worst fear come true: I’d major in music theater, and grow up to star in porn films. A book about porn would be adjacent. Ha.)
Substack will probably throttle this newsletter because of the number of times I use the word PORN.
Your LIKES and RESTACKS will combat algorithmic censorship.
Please share this newsletter with every persuadable voter you know.
