Just to set the scene before getting into the latest on the Ilhan Omar investigation, here’s ** some fun from the Babylon Bee** (linked to over the weekend, but you shouldn’t miss this).
And now, a question: why should agents have been digging into Minnesota Rep. Omar’s trash in advance of the raid on her DC home, reportedly for DNA? As investigative reporter Catherine Herridge explains, obtaining DNA evidence is a common way for investigators to determine if a suspect has committed immigration fraud by marrying a family member. (Omar wouldn’t be the first, you know.) “There is a long-standing allegation,” she writes, “not independently confirmed, that Ilhan Omar married her brother to secure his citizenship, a claim she has fiercely denied to various media outlets.” We shall see.
This search was done in advance of the warrant being served, but the law considers discarded trash to be fair game, with or without a warrant, if presenting a warrant would tip off the target of an investigation. (Of course, she and her family had to know this investigation was going on, but they wouldn’t necessarily have known a raid was imminent.) Police don’t have to show probable cause to retrieve items that have already been thrown away. Some very high-profile criminal cases have been cracked by this method of obtaining DNA.
